This is the perfect step-by-step book on what to do if you think you have a case that you want to take to small claims court. It starts with basic definitions of what a small claims court is, what types of cases are usually tried there and advice on how to know if you have a sound case or not.
It is broken into chapters, each addressing a key issue involved with going to small claims court. The first few chapters include what you will need to do to prepare for small claims court. There are many good examples of “demand letters” which is the first step in beginning the process of going to small claims court. The author also includes many good resources that you can use to help determine if you actually need to go to small claims court.
Subsequent chapters deal with many special issues, such as what types of things can go wrong in court, such as countersuits and counterclaims. The author examines an exhaustive list of the types of cases that can be brought to small claims court, very helpful if you aren’t sure if you even have a case or not. The author goes through how to get organized for court, including how to budget your time and what kind of paperwork you will need to have prepared. Next topics such as: problems that arise before your court date, preparing for the actual day in court, how to select an expert witness, and what to do if you lose your case are discussed.
The appendices are extremely helpful. There is a glossary of terms which covers pretty much any word that you may need to know in reference to small claims court. The appendices also include a state by state listing of the most important information for each state’s small claims court. And if that isn’t enough information for you, then the author also includes Web sites for each state where you can find further resources.
The best part about this book are the many examples of documents and letters provided that you can use as a guide when creating your own case. Also the author included a large number of outside resources and Web sites that are extremely helpful to someone who is trying to go through this process without a lawyer.
I would highly recommend this book to anyone who may be considering taking a case to small claims court, I can’t imagine a more comprehensive guide.

Did you ever have a dispute and wanted to sue? If so, “How to Win your Case in Small Claims Court” by Charlie Mann is an essential resource for individuals not familiar with the court system as well as individuals who need a refresher before appearing in court. The book is a detailed manual which clearly explains the numerous aspects of preparing your court case.
The book discusses how to prepare and file court documents, subpoena individuals, present your case, hire expert witnesses (if necessary) as well as steps on how to collect your judgement and closing your case. Also, the book includes websites, law terminology and examples of documents which are vital for presenting and winning your case.
The book provides very relevant information and provides step-by-step instructions on how to win a court case. It is not just an informational book for individuals who do not have a legal background but also valuable resources for individuals who reside in any state. Overall, I give the book 4 stars-it provides sufficient information about small claims court cases but it does not take the place of obtaining the advice and guidance of an attorney.

How to Win Your Case In Small Claims Court Without a Lawyer by Charlie Mann offers the reader aid in performing all the necessary tasks needed to win a case. Mann takes the reader from analyzing a case, to arguing it in court, and finally to collecting payment if the case is successful. He even helps the reader if the case is unsuccessful by providing useful information on filing for appeals or for a second trial. Mann guides the inexperienced through the entire procedure, explaining legal rules and pointing out differences in law between different states, all the while using examples from actual cases to illustrate his points. At the end of each chapter is a brief summary which captures the main points of that chapter.
The writing is easily accessible to anyone. The legal terms are well-explained and there is an appendix at the back of the book that provides definitions for any legal term used in small claims court. Since legal proceedings are different in every state, Mann also provides a summary of each state’s small claims court laws, including the monetary limit for a case and general statute of limitations. All in all, this is an excellent resource for anyone who finds themselves in a small claims lawsuit, whether as the plaintiff or the defendant.

|OK as a second resource; not as good as the court websites,
MOST OF THIS INFORMATION IS AVAILABLE ON THE COUNTY COURT WEBSITES.
The California court system has excellent websites explaining how to do anything in court. Each county has a different website for civil lawsuits, although some counties have combined resources with other counties. I found the Santa Clara websites to be better than Alameda County.
The Santa Clara superior court website is much better than this book and is easier to read. The main text of this book is 283 pages, hard to navigate and takes days to get through. I got all the information I needed from the Santa Clara County website within a few hours. (search for Santa Clara Court Self Help).
The Santa Clara website also has better information, such as deciding whether to sue in small claims court or to file in Superior Court. Small claims court does not allow discovery (you cannot request information from the party you are suing). So, if the opposing party has an important document or video surveillance that would help your case, you cannot get that in small claims court and must sue in Superior Court if you really need it. The website covers this, while the book does not.
So, if you are trying to decide if you want to sue someone, go to the county court websites first. If you decide you want to sue someone, then you probably should buy this book. If you are going through the expense of suing someone, you will want all the help you can get. This book does have some rudimentary tips on how to handle yourself during a lawsuit.

|Great resource yes, but be ready to put in serious effort.,
In the right hands, this book can be a valuable, even powerful tool. Don’t let the “Do-it-Yourself” tone give you anything resembling confidence when filing suit. I practiced law in Los Angeles County for eleven years, trust me when I tell you a civil lawsuit in Superior Court is an extremely complex and detailed undertaking. You paperwork, deadlines and filings all must be neat and precise if you want the court (ot your adversary’s attorney) to take you seriously.
Indeed, Win Your Lawsuit: Sue in California Superior Court Without a Lawyer offers an impressive – even comprehensive array of resources to guide you through the process. Its author Judge Roderick Duncan has earned a reputation for producing well organized, common-sense books to guide non-attorneys through several areas of law. The book includes most all Superior Court forms, the rest are available on their website. It can be done. You can sue by yourself, and you can win. But be prepared to supplement this workbook with a pretty substantial dedication of your time if you’re serious about winning.
And don’t be surprised if you meet some daunting resistance in the courtroom … some judges DO NOT LIKE Pro se parties (non-lawyers) in their courtrooms. I’ve seen a few who actually take offense at the idea. So be prepared to win the judge over with your preparation and attention to detail.
Couple tips from me, 1)Keep a dedicated calendar exclusively for the lawsuit. Missed deadlines can kill you, 2) Enlist a family member or friend to get involved, someone to take a second look at everything you do, and 3) avoid anger and emotion like the plague.
Four stars for this book, deduct one for its marketing-driven, misleading “do-it-yourself” tone.

This is a thorough manual that leads you from the very first point of “Representing Yourself” and “Limited Jurisdiction Case” to the preparation parts of “Selecting the Right Court” and “Beginning Your Tort or Contract Complaint” then to the actual trial phase including “Discovery Rules and Limits” and “Sizing Up the Judge” to the end with “Closing Arguments” and “Requesting a New Trial”.
Sample forms filled out with information is supplied in many sections to serve as examples. There are little boxes throughout each section including “Tip”, “Resource”, and “Caution” that give you additional helpful advice. In the last section of the book(Appendix A), you get a large selection of tear-out forms.
Including a CD with this book would have been better(for some reason certain Nolo books contain a CD while others don’t). Overall I would say this book would be more useful for beginners or people who have never gone through the process of suing in California. If you are a small business owner it might be a good idea to have this book handy just in case.
